Today TaxMama hears from Gina in MD who tells us. “I have a tax lien that is over 10 years old. How can I remove it from the court records? It is not attached to my home and it has been file for over 10 years.”
Dear Gina,
I have good news for you – and bad news.
First the bad news – If there is a tax lien out there – it IS attached to you – and your home and anything else you might own. Liens are general notices that people will find whenever they run your credit or run title when you want to sell anything.
Then the good news – If the 10+ year-old tax lien is from the IRS, the tax debt tends to expire after 10 years – unless you’ve ever filed for an offer in compromise, bankruptcy or a Tax Court petition, or…If the tax debt has expired, it’s easy to get an IRS lien removed. It just takes a little time.
When it’s from a state, they might have a different statute of limitations. You’d have to check with them to see how long your tax debt is collectible.
For an expired IRS lien, contact IRS’s special lien services phone number – 1-800-913-6050 . They can tell if you the debt has expired (or been paid off) – and what you need to do to get the lien removed.
