In the course of what I do and what I write, I encounter ever more legislation and more complex procedures constricting our lives. And people. Sometimes the despair radiating from people caught in the sticky web of laws too convoluted to understand, much less comply with…It could be crippling. But it’s not. Why?

Yesterday I got a note from Rebecca Madigan, the executive director of Performance Marketing Association, an organization you ought to know about. PMA is an organization dedicated to bringing ethical sales and marketing practices to the Internet – where you are shopping ever more frequently.
One of the other things they do is advocate on our behalf regarding the ever more intrusive sales tax legislation of states short on revenues. You may not be aware, but states are starting to insist that businesses who have any form of nexus (presence) in their state must start charging sales tax and pay income taxes – even if the presence is only minimal. What is minimal? An affiliate in the state has a link to your business on their website. Or an fan tells everyone they know about you in their blog – and you pay them a referral fee. Yes. That’s all the presence some states may require in order to claim you have nexus. Ugly. (See chapter 12 of Small Business Taxes Made Easy.)
Rebecca contacted me because she is gearing up for a meeting with the California state legislators about this issue sometime this month. Would I join her? You bet! How could I say no?
