From Stickney, IL  You can't BOTH be on the payroll AND receive a 1099. It's one or the other. Frankly, from your brief description, it appears that you SHOULD be on payroll. And not doing that will cause your brother some potential problems...and you to pay extra taxes. If in fact, you really are an independent contractor, in business for yourself, and you are entitled to deduct all reasonable expenses on your Schedule C.
