Dear Eva,

Depending on the tax consequences, why doesn't the husband file an amended return, using a 1040X  and report his income using the MFS (married filing separately) status?

The mother might be eligible for the EIC and the Child and dependent care credit too. Moreover her filing status would be HOH (head of household), another improvement.

I can't really figure this out without the numbers from everybody, and their situation.
