Dear TaxMama:

I had 2 child care providers this year for my son. The first (whom I no longer use) was paid $596.00. She is refusing to provide me her SS# so I can claim this. (She won't give me a reason). I've sent her the "official" Federal Tax ID request form and she will not respond. Do I have any recourse?

I have her name, address & phone number. Should I submit it or just eat it?

Hi Stacy,

That's why I always recommend getting that information BEFORE you pay them.

When people want money, they are more apt to be cooperative. And then, before they have access to shaping your child's mind, you learn about their ethics. Personally, I wouldn't want someone dishonest raising or caring for my child. Think of the values she would teach him. (Aahh, that's why you left her ...)

So, yes, just submit your Form 2441 with her name and address. Attach a statement to your tax return explaining that you tried to get her Social Security Number, but she refused to provide it. Include her phone number on the statement.

That will help you get your Child Care Credit - and will cause her to be audited, someday.

Meanwhile, though, you won't be able to file electronically - so she is also costing you a quick refund. But, at least her action is not costing you the credit.
