My husband is a non resident and is not working due to the fact he has not received work authorization from INS. We don't own a house. We sublet a little house from a couple. You can file as married, filing jointly. Even if he's not working. By the time December rolls around, I'm sure your husband will have papers and be blithely working and supporting you and your baby.
