» From: Blowing Rock, NC Dear TaxMama: If you gave your CPA the correct information and they mess up, are they responsible for the penalties and interest? Donna ![]() The answer is - a definite - maybe! Really, Donna, it all depends. When you gave them the information. What form it was in? Was the pertinent information buried among a lot of junk? Was it clear? I've seen so much data from clients in so many different indecipherable formats, there's no way to answer you without seeing the file. In general? My policy? And that of most ethical tax pros? If we get data from a client and we overlook it, or we make a mistake? We'll pay the penalties. But we won't pay the interest. IF you go to court, you'll probably get that same result. Had the return been done right, you'd have owed the tax anyway So, since you didn't pay it and had the use of the money in the meantime, the interest is yours. Generally, though, for most issues, if we ask nicely, we can get the penalties eliminated. Ask you CPA to help you and to write the letter making the request. You have my sympathy. I know this can be so stressful. But talk to your CPAs. They will help you. Best wishes, Eva Rosenberg Your TaxMama |
