From: New Milford, Ct Dear TaxMama, This year I spent over 6,000.00 on lawyer fees because my ex husband wanted to have joint custody. After all was done and over, I kept my sole custody because he has a proven drinking problem. I had to pay these fees to protect my daughter from him. Can I claim anything on my income tax statement? Cindy ![]() You have my heartfelt sympathy over your struggle. And I do hope this is the last time you have to fight. But, the tax code won't help you. You see, child support and custody issues do not result in taxable income. Unfortunately, the only legal fees anyone can deduct are for issues that could generate taxable income (alimony, pension, profit splits from join businesses...) So sorry to be so disappointing.
